This is a slippery slope, as it might end up in a discussion of 
liability issues, but under German law we form a "Gesellschaft 
bürgerlichen Rechts" by virtue of "konkludentes Handeln", and thus it is 
possible for us to be the a party in a lawsuit.

It's probably a good idea to come up with something more formally 
defined, though.
